Emails Show Dem AGs Are Wary Of Launching RICO Case Against Exxon
Internal emails reveal attorneys general are worried investigations of ExxonMobil for its global warming stance is an exercise in “rhetorical overreach.”
Emails released by conservative legal group Energy & Environmental Legal Institute (E&E Legal) show state attorneys general are not in lockstep with New York Attorney General Eric Schneiderman’s investigation into Exxon that’s ensnared groups labeled as skeptical of man-made global warming by environmental activists.
Internal concerns began to flare up after Schneiderman’s press office released a statement in March that announced “[a]n unprecedented coalition of top law enforcement officials committed to aggressively protecting and building upon the recent progress the United States has made in combating climate change.”

The reefs can’t be made whole again: if they recover at all it will be slowly, and in the face of ongoing warming that seems unlikely. But at the very least, the nations that sustained this damage should be compensated. Exxon and its brethren made record profits in the last decades of denial and deceit; that money should rightfully go to pay for the damage it caused, and to build the energy systems that can power our lives without destruction.
We need to remember that there’s nothing natural about this horror. It was caused, as so many crimes are, by greed. And that greed is ongoing – Exxon continues to search for more hydrocarbons, and to reject even modest changes to its policies.
That’s why we’re wrapping crime scene tape this week around those bleached coral heads, those dead staghorns. That’s why we’re taking crime scene photos with underwater cameras. That’s why we’re protesting on the reefs. We’re not going to let them get away with murder.

Stein’s promise comes after Democratic lawmakers have been urging the Obama administration and state attorneys general to investigate Exxon for allegedly misleading the public about global warming by funding groups skeptical of government climate regulations.
Stein is running for president as the Green Party nominee. The Green Party is a left-wing party focused mainly on environmental issues. The firstplank of her presidential platform is a “Green New Deal” to “turn the tide on climate change, revive the economy and make wars for oil obsolete.”…

…Democratic prosecutors invited to help Obama, join pursuit against climate change skeptics
When New York Attorney General Eric T. Schneiderman invited other Democrats to join his effort to pursue climate change skeptics, he was interested in more than bringing lawbreakers to justice.
A letter obtained by E&E Legal Institute and released Tuesday indicates Mr. Schneiderman was also interested in advancing the Obama administration’s climate-change agenda, including the Clean Power Plan and the Paris climate accord.
“The commitments of the United States and other nations at last year’s Paris climate change conference are very significant steps forward, but states must still play a critical role in ensuring that the promises made in Paris become reality,” Mr. Schneiderman said in a March 7 letter.
“Put simply, while we have accomplished a lot, much more action to stem climate change and expand the availability and usage of renewable energy is needed, and is needed now,” said the letter, which was also signed by Vermont Attorney General William Sorrell.
The letter offers fresh evidence that the Democratic-led coalition of 17 attorneys general was aimed at burnishing President Obama’s climate legacy as opposed to ferreting out wrongdoing in the form of climate change “fraud,” according to the institute.
Secret Deal Among AGs to Prosecute Climate Change ‘Deniers’ Challenged in Court
By signing a “secrecy pact” with fellow Democrat attorneys general preparing to prosecute climate change skeptics, Rhode Island’s top law enforcement officer jeopardized free speech rights and government transparency laws, according to two legal organizations that have taken him to court.
“They sought to write themselves out from open records laws their legislatures saw fit to write them into,” @ceidotorg’s Chris Horner says.
Rhode Island Attorney General Peter Kilmartin’s tactics in supporting President Barack Obama’s climate change policy violate state law guaranteeing access to public records, the two groups, Energy and Environment Legal Institute and Free Market Environmental Law Clinic, claim in their lawsuit.
If Kilmartin and the other attorneys general prevail in the deal to keep select details secret, the ordinary citizen will be the loser, Chris Horner, a leading critic of climate change orthodoxy, said.

“It will mean that they can create privilege for what are otherwise public records, even when shared with ideological activists and donors, so long as everyone who wants to keep their scheming secret agrees in advance,” Horner told The Daily Signal.

Thelawsuit, filed July 27 in Rhode Island Superior Court, calls for Kilmartin, a Democrat, to release records that were not previously disclosed in response to the legal organizations’ request in April.
At issue is a “Climate Change Conference Common Interest Agreement” that, email records show, Kilmartin’s representative signed along with representatives of 16 other state attorneys general.
In the past few months, leading political figures and academics who support Obama’s policy on climate change have called for prosecuting those who disagree under the federal law known as RICO—the Racketeer Influenced and Corrupt Organizations Act.
Congress passed RICO in 1978 for the purpose of prosecuting mob crimes, but now climate change activists want to use it against organizations, corporations, and individual scientists who are not convinced that human activity is responsible for catastrophic climate change.…
